One of the main challenges is that banks often require more extensive due diligence before approving finance. Lawyers generally have fewer issues as long as the Sale and Purchase Agreement (S&P) is straightforward.
In private sales, it’s important to conduct thorough independent due diligence to ensure the property and all associated matters are in order.
Overall, a private sale is not fundamentally different from a sale by negotiation—you are simply dealing directly with the vendor. Your lawyer will prepare the same S&P, and the settlement process is the same as any other property transaction.
